WAIVER & RELEASE – FOR ALL ADULT AND CHILD REGISTRANTS
By clicking “I Agree” below, I acknowledge that I understand this document and its intent and I, and all additional registrants, agree to its terms and conditions.
I/we for myself, my heirs, executors, administrators and representatives, do hereby agree to and will absolve and hold harmless the Michael J. Fox Foundation for Parkinson’s Research (“MJFF”) and its directors, officers, employees and volunteers, the ride leaders (if any), other sponsors, Hoag Memorial Hospital Presbyterian c/o California Commercial Real Estate Services, 1800 Quail Street, Suite 100, Newport Beach, CA 92660; Shady Creek LLC, Hoag Memorial Hospital Presbyterian, a California Real Estate Services, PDP Shady Creek LLC, PDP Shady Creek Retail LLC, Del Oro LLC, PMB Irvine MOB LLC, PMB Irvine Retail LLC, PMB LLC Southern California Edison Company, State Farm Life Insurance Company and their event staff, cooperating organizations and any other parties connected with the SoCal Ride for Parkinson’s Foundation (“the Event”), the Directors of the SoCal Ride for Parkinson's Foundation and their respective successors and assigns, singly and collectively (all of the foregoing, from MJFF through assigns, the “Releasees”), from and against any blame and liability for any Event related injury, harm, loss, inconvenience or any other damage of any kind whatsoever.
I/we freely and voluntarily accept all risks of injury, death, or property damage related to the Event. I/we understand and agree that none of the Releasees may be held liable in any way for any occurrence or accident in connection with an Event. I/we hereby WAIVE, and RELEASE from, any and all liability and agree to INDEMNIFY AND HOLD HARMLESS the Releasees against all claims, including, but not limited to, claims of negligence, unintentional acts, and acts of omission, and any damage, loss or expense, related to my participation in any Event. I/we understand that I/we am responsible for my own conduct and decisions while participating in the Event and further agree that this Waiver & Release shall apply to any claim arising out of my participation in bicycling and non-bicycling activities related to the Event. If I/we bring a dog to the event, I/we acknowledge that I/we are responsible for the conduct of the dog as to regards of other dogs and people.
I/we WILL OBEL ALL TRAFFIC LAWS.
I/we hereby consent to and permit emergency treatment in the event of injury or illness while participating in the Event.
I/we understand that all youth riders (under 18) must be accompanied by an adult at all times and can be removed from the course if found to be unaccompanied. I/we hereby waive and release on behalf of any youth rider accompanying me/us.
I/we am aware that with any bicycle/walking/running related activity there are certain inherent dangers, including but not limited to the hazards of roads, accidents, actions of participants and other persons. By my participation in the Event, I/we certify that I/we am aware of these inherent dangers of bicycle riding and the safety rules of the road applicable to bicycles.
I/we understand that bicycle helmets are required to participate in all riding aspects of the Event and I/we agree to wear a helmet while riding in the Event and to follow the rules of the road and all applicable laws and safe bicycling practices.
I/we agree that the Releases will not be responsible for any delay, interruption or other failure to perform, and may cancel the Event for any reason. SoCal Ride for Parkinson's Foundation will be the sole decision maker as to what, if any, refund or other accommodation will be made if the Event is cancelled.
I/we hereby give permission to SoCal Ride for Parkinson's Foundation to use my name or image by way of a photograph, video or audio format taken of me during the Event in any promotional materials, publications or any other electronic media in addition to disclosing my name on the SoCal Ride for Parkinson's Web site, which includes online pledging.
SoCal Ride for Parkinson's Foundation may exercise its right to refuse or dismiss anyone from the Event or Event related activities if a person may cause any disturbance or hindrance in or to the Event or SoCal Ride for Parkinson’s Foundation.
